<p>From the moment the president signed the nuclear arms reduction pact with the Russians, Senate Republicans, led by Sen. Jon Kyl (R-AZ), have “kept moving the goal posts…”</p>
<p>Max Bergmann briefly laid out <a href="http://wonkroom.thinkprogress.org/2010/11/16/kyl-vote-move-on/" target="_blank">the history of Kyl’s delay tactics</a> within his Nov. 16 <em>Wonk Room</em> post.</p>
<blockquote><p>…Last summer, Kyl was whining immensely that the Senate Foreign Relations Committee (SFRC) was rushing the process and that a committee vote should not happen until after the August recess. After the SFRC delayed, Kyl spoke to Reuters <a href="http://af.reuters.com/article/energyOilNews/idAFN0427711420100804?pageNumber=2&amp;virtualBrandChannel=0&amp;sp=true">who paraphrased Kyl</a>:</p>
<p style="padding-left: 30px;">It could be difficult to satisfy his [Kyl's] demands before November and thus the vote on <strong>New START might need to take place during the lame duck session</strong> if the Senate wants to vote on the treaty this year…</p>
</blockquote>
<p>The vote was delayed, and <a href="http://www.nytimes.com/2010/11/17/world/europe/17start.html?_r=2&amp;hp" target="_blank">Kyl’s demands were met</a>, but…</p>
<blockquote><p>In September, after the SFRC did hold its vote, Kyl and Senate Republicans argued that having a vote before the election was impossible because it would politicize the process and that a vote should happen after the election…</p></blockquote>
<p>Predictably, now that the election has passed, Kyl and Republicans say there <a href="http://www.theatlantic.com/politics/archive/2010/11/kyl-attempts-to-stop-start-treaty/66653/">isn’t enough time in the Senate calendar</a>.</p>
<p>Of course, for Kyl and the Republicans, that was the plan all along, as it has been with every White House initiative since Obama took office.  Playing this game with foreign policy commitments, however, has broader implications than it has with domestic legislation.</p>
<p>The consequences are already presenting themselves.  Steve Benen, author of Washington Monthly’s <em>Political Animal</em> blog, has been <a href="http://www.washingtonmonthly.com/archives/individual/2010_11/026705.php" target="_blank">on this</a> <a href="http://www.washingtonmonthly.com/archives/individual/2010_11/026689.php" target="_blank">all week</a>.  Regarding the risks Republicans are running, <a href="http://www.washingtonmonthly.com/archives/individual/2010_11/026673.php" target="_blank">Benen wrote</a> (11/17), “They expect this to hurt the foreign policy power of the United States, but they’re fine with that since there’s a Democratic president…” (<em>emphasis <strong>added</strong></em>)</p>
<blockquote><p>When it comes to Russia, inspection of the country&#8217;s long-range nuclear bases will remain suspended indefinitely; the country&#8217;s hard-liners will be emboldened; and Russia&#8217;s willingness to cooperate with U.S. on Iran or on Afghanistan will likely disappear.</p>
<p><strong>But in the bigger picture, countries around the globe will see this as a reminder that negotiating with the United States is pointless, since the country is burdened with a Republican Party that puts partisan hatred above the country&#8217;s interests.</strong> It hurts American credibility in ways that are hard to even gauge.</p></blockquote>
<p>Indeed, and as Matt Cooper <a href="http://www.nationaljournal.com/whitehouse/nuclear-treaty-blow-comes-has-political-fallout-too-20101116" target="_blank">noted</a> in his Nov. 16 National Journal post, another bilateral agreement – a trade pact with South Korea – initially failed, in part, because “Seoul’s concern about ratification prospects in the Senate.”</p>
<p>Fortunately, there still a chance that Senate Democrats will force a vote on START before the next Congress.  If they do, it will be interesting to see whether or not the Republicans blink.  Only one elected Republican, Indiana Senator Dick Lugar, has <a href="http://www.youtube.com/user/senatorlugar#p/u/0/yTZE3HRnOAM" target="_blank">called on his party</a> to put national security before politics on this one, and numerous other <a href="http://www.salon.com/news/nuclear_weapons/index.html?story=/news/feature/2010/11/18/us_us_russia_nuclear_3" target="_blank">non-elected officials from both sides</a> have done the same.</p>
<p>I’d like to think Sen. Lugar isn’t the lone Republican voice of reason in the Senate.  Optimism, however, is difficult to muster when there are others, like Sen. John Barrasso (R-WY), who seems to relish the opportunity to <a href="http://thinkprogress.org/2010/11/17/barrasso-soviet-threat/" target="_blank">poke the Russians with a stick</a>.</p>

			<content:encoded><![CDATA[<p><strong>This clip from <em><a href="http://www.theonion.com/" target="_blank">The Onion</a></em> is from November 2009.  If someone had told me then that the GOP would have made the gains that they did in the 2010 midterms, I would not have believed them.</strong></p>
<p><strong>Actually, Republicans should consider Zombie Reagan for their leadership.  If I learned anything from the 2010 midterm results, it would be that the only demonstrably functioning appendage of the GOP is its <a href="http://mediamatters.org/research/201011020054" target="_blank">propaganda/fundraising wing</a>.  Whether or not they&#8217;ll be able to actually govern remains in serious doubt.</strong></p>
<p><strong>From the looks of <a href="http://tpmdc.talkingpointsmemo.com/2010/11/the-crazy-class-of-2010-meet-the-new-gop-stars.php" target="_blank">their freshman class</a>, the famed Republican unity-of-message, lockstep discipline is a thing of the past.  Their leadership is in for a frustrating experience, akin to what the Democrats dealt with during the last Congress (noteworthy exceptions being the complete lack of empathy, and despite the inherent contradiction, a lot more Jesus).</strong></p>
<p><strong>Zombie Reagan?  They could do worse.</strong></p>

			<content:encoded><![CDATA[<p>For the most part the script for Elana Kagan&#8217;s appearance before the Senate Judiciary Committee had already been written.  Historian Joseph J. Ellis <a href="http://www.washingtonpost.com/wp-dyn/content/article/2010/05/02/AR2010050202446.html" target="_blank">described the scene well</a> nearly two months ahead of time:</p>
<blockquote><p><strong>These hearings have become highly partisan affairs over the past 30 years, and given the recent closed-ranks posture of the Republican opposition, we can expect all the sharp-edged political weapons to be deployed against the nominee. The chief weapon will be the claim that Supreme Court justices should interpret the Constitution as it was written, not impose their political or personal convictions on the semi-sacred text. Woe to the nominee who has left a paper trail that deviates from the original intentions of the Founders, or what a hostile Senate interrogator defines those intentions to be.</strong></p></blockquote>
<p>The RNC, for their part, telegraphed their Party&#8217;s intentions for the hearings in advance.  As noted at <em>The Hill, </em>May 10, <a href="http://thehill.com/blogs/blog-briefing-room/news/96909-gop-uses-thurgood-marshall-to-attack-kagan" target="_blank">Republicans on the Judiciary Committee </a>would focus on Kagan&#8217;s DADT position at Harvard, and her 1993 speech before the Texas Law Review in honor of Justice Thurgood Marshall.</p>
<blockquote><p><strong>&#8230; She quoted from a speech Marshall gave in 1987 in which he said the Constitution as originally conceived and drafted was “defective.”</strong></p>
<p><strong> </strong><strong>Marshall cited in particular the definition in the original Constitution to slaves as representing three-fifths of “free Persons” when counting the nation’s population. That reference was rendered moot after the Civil War with the ratification of the 13th and 14th amendments abolishing slavery and granting full citizenship to all people born in the U.S.</strong></p></blockquote>
<p>True to form, the GOP contingent led by Sen. Jeff Sessions (R-AL) proceeded to frame Marshall as a &#8220;liberal activist&#8221; &#8211;   the same Justice Marshall whose work on behalf of the NAACP in 1954 helped facilitate the end of segregation, later serving as U.S. Solicitor General, elevated to the Supreme Court during the LBJ administration.</p>
<p>Interestingly, when asked later, Senators Sessions, Orrin Hatch (R-UT), and Tom Coburn (R-OK) were <a href="http://tpmdc.talkingpointsmemo.com/2010/06/thurgood-who-republicans-hard-pressed-to-disagree-with-marshall.php" target="_blank">unable to list a single instance of &#8220;judicial activism&#8221; perpetrated by Marshall</a>.  But their strategy wasn&#8217;t about making a sustainable legal argument; rather, Republican criticism of Marshall turned out to be yet another sounding of the dog whistle intended for their base who, apparently, lament the outcome of <a href="http://en.wikipedia.org/wiki/Brown_v._Board_of_Education" target="_blank">Brown v. Board of Education</a> &#8211; <strong>Stay classy, GOP!</strong></p>
<p>Fortunately Senator Al Franken (D-MN) was on hand to set the record straight on two counts.  Watch the below clip, snipped by <em><a href="http://firedoglake.com/2010/07/01/early-morning-swim-sen-al-franken-demolishes-gops-anti-thurgood-marshall-campaign/" target="_blank">firedoglake.com</a></em>, as Franken elevates the term &#8220;judicial activist&#8221; out of the meaningless context in which it is so often used, successfully defending Marshall&#8217;s legacy in the process.</p>
<p>Within his assessment of the &#8220;<a href="http://harpers.org/archive/2010/07/hbc-90007336" target="_blank">Judiciary Committee Winners and Losers</a>,&#8221; <em>Harper&#8217;s </em>Contributing Editor and legal expert Scott Horton highlighted Franken&#8217;s performance:</p>
<blockquote><p><strong>&#8230;I applaud Al Franken. Not only did he provide an alternative point of interest during slow points with his </strong><a href="http://blogs.citypages.com/blotter/2010/06/al_franken_dood.php"><strong>skillful doodling,</strong></a><strong> Franken also proved himself an astute student of the Republicans. For years, they have used confirmation hearings to take their digs at their least favorite judges and judicial policies. Franken has responded in kind, taking a deep look at the Roberts court’s strange biases in favor of business and against labor and its innate hostility to business regulation. Who are those “activist judges” that Sessions complained about? Franken makes a persuasive case that they’re precisely the judges Sessions is so wild about: John Roberts, Sam Alito, Nino Scalia, and Clarence Thomas.</strong></p></blockquote>

			<content:encoded><![CDATA[<p style="text-align: left;">Back from his vacation, Stephen sends up Senator Jim &#8220;Creme&#8221; DeMint (R-SC) and his &#8220;Waterloo&#8221; meme.  DeMint articulated what became the Republican strategy to &#8220;break&#8221; Obama by defeating the administration&#8217;s effort to reform health care in July, 2009.</p>
<p style="text-align: left;">Now that the Democrats have successfully passed reform, DeMint has taken to pushing back the goal posts, <a href="http://www.cbsnews.com/stories/2010/03/28/ftn/main6341068.shtml?tag=contentBody;featuredPost-PE" target="_blank">telling</a> <em>Face the Nation</em>&#8216;s Bob Schieffer that the true test of the GOP&#8217;s cynical strategy will come with the results of the 2010 midterm elections.</p>

<p>President Barack Obama outlined his administration&#8217;s proposal Wednesday, seeking to bring reform of the American health care system to a successful conclusion.  Considering  the recent spurious criticisms from reform opponents, it appears that, indeed, the arduous process of steering health care reform through Congress may well be nearing its end.</p>
<p>It&#8217;s really only become apparent in the last week or so.  Leading up to and during the White House bipartisan health care summit, Republican politicians have <a href="http://wonkroom.thinkprogress.org/2010/02/26/agree-summit/" target="_blank">repeatedly</a> acknowledged the need for reform, but that Democrats should scrap their health care bills and &#8220;start over.&#8221;</p>
<p>Meanwhile, the Democrats began to show some spine leading up to the summit, signaling their willingness to use the budget reconciliation process to pass reform, if necessary.  Consequently, Republicans&#8217; concerns over the use of reconciliation became more prominent within their media talking points, and at the Blair House summit where the issue was frequently raised. Since the summit&#8217;s conclusion, however, GOP concerns over reconciliation have evolved into what appears to be panic.</p>
<p>Republicans are decrying the potential use of the parliamentary measure, attempting to gloss over the <a href="http://theplumline.whorunsgov.com/gop-senators-votes-on-reconciliation/" target="_blank">GOP&#8217;s historical record</a>, having happily employed the measure when it suited them.</p>
<p>Further, in their attempts to rationalize their hypocrisy &#8212; insisting that the pending health care legislation is beyond the parameters of reconciliation &#8212; they have engaged in a campaign of historical revisionism.  Senator Orin Hatch (R-UT) wrote an op-ed, published Mar. 2 in the increasingly subjective <em>Washington Post</em>, is a prime example of how Republicans are falsely framing the historical use of reconciliation.</p>
<p>Regarding Hatch&#8217;s opinion piece, Steve Benen of <em>The Washington Monthly</em>writes, &#8220;Hatch is simply and unambiguously wrong.  And the <em>Post</em> published his demonstrably false arguments anyway&#8230;&#8221; <a href="http://www.washingtonmonthly.com/archives/individual/2010_03/022657.php" target="_blank">From Benen&#8217;s </a><a href="http://www.washingtonmonthly.com/archives/individual/2010_03/022657.php" target="_blank"><em>Political Animal</em></a><a href="http://www.washingtonmonthly.com/archives/individual/2010_03/022657.php" target="_blank"> blog, Mar. 2</a>:</p>
<blockquote><p><strong>The whole pitch is absurd to the point of being insulting. Hatch has </strong><a href="http://theplumline.whorunsgov.com/senate-republicans/hatch-vows-reconciliation-will-lead-to-permanent-war-beween-parties-but-he-backed-many-reconciliation-bills/"><strong>repeatedly supported</strong></a><strong> up-or-down votes on legislation large and small. Indeed, he thought it was a great idea for delivering massive tax breaks for the rich &#8212; packages that cost far more than health care reform now &#8212; but whines incessantly when Dems consider the same procedure to pass a modest fix related to health care.</strong></p>
<p><strong>Hatch really ought to be embarrassed.</strong></p></blockquote>

<p>Adding emphasis to his lack of shame, Hatch tweeted his response to Maddow&#8217;s damning assessment.  Here&#8217;s his tweet by way of <a href="http://www.politicususa.com/en/maddow-hatch-twitter" target="_blank"><em>PoliticusUSA</em></a>:</p>
<blockquote><p><strong><em>@maddow ran me down on her show last night over my views on health care reform. Wonderful badge of honor.</em></strong></p></blockquote>
<p>However, if you watched the above clip you&#8217;d know that Maddow&#8217;s assessment had nothing to do with his &#8220;views.&#8221;  Rather, as Maddow indicated in her response tweet, it was Hatch&#8217;s misstating of the facts which were at issue.</p>
<p>Sadly, no matter how plainly the GOP&#8217;s efforts to falsely frame reconciliation are laid out, they&#8217;ll continue beyond the bill&#8217;s passage.  And, as Maddow put it in the above clip, &#8220;It&#8217;s going to pass.&#8221;</p>
<p>What I&#8217;m struggling with is, how could Republicans expect anything different from the Democrats?  It seems to me that consistently obstructing Democratic efforts on health care &#8212; and everything else, for that matter, guaranteed that reconciliation would be used.</p>
<p>They&#8217;ve already telegraphed their intentions to use health reform&#8217;s passage as a campaign issue in the 2010 midterms, asserting that using reconciliation will cost the Democrats votes.  However, wouldn&#8217;t a failure by the Democrats to use any means at their disposal to conclude a year&#8217;s worth of work cost them more?</p>
<p>Frankly, the GOP needs to get over it.  I think is was Jon Stewart who put it best.  Following Obama&#8217;s 2008 election to the presidency, Stewart reminded the already whining congressional Repbulicans of what their electoral losses meant.  &#8220;You&#8217;re in the minority,&#8221; Stewart said.  &#8220;It&#8217;s supposed to taste like a s#!t sandwich.&#8221;</p>

Without what&#8217;s called &#8220;unanimous consent,&#8221; under Senate rules, pending nominations must be returned to the President, who then has to re-nominate in the next session. In what has become a far too typical exercise by the &#8220;Just Say No&#8221; party, Republicans objected to three DOJ nominees who have been on the Senate’s calendar awaiting consideration for months: Dawn Johnsen, for the Office of Legal Counsel; Chris Schroeder for the Office of Legal Policy; and Mary Smith, for the Tax Division. They also objected to two pending federal District Court nominees (Edward Chen, for a seat on the Northern District of California and Louis B. Butler for a seat on the Western District of Wisconsin) and to Craig Becker for reappointment as a member of the National Labor Relations Board&#8230;</p>

			<content:encoded><![CDATA[<p>Again, Stephen Colbert displays why satire is the perfect lens through which to analyze the Republican Party.  Playing on comparisons of the <a href="http://msnbcmedia.msn.com/i/MSNBC/Sections/NEWS/A_Politics/Reagan_First_Read.pdf" target="_blank">RNC&#8217;s 10 requirements</a> &#8212; of which potential candidates must adhere to eight to receive funding &#8212; to the Biblical Ten Commandments, Colbert listed some of its strict conservative prescriptions and noted, &#8220;They&#8217;re just like the 10 Commandments, if one of the tablets said &#8216;F&#8217; and the other said &#8216;U.&#8217;&#8221;</p>

<p>There is one bit of irony I wish Colbert would have touched on.  As <a href="http://www.care2.com/causes/politics/blog/rnc-purity-test-policy-prescription-or-internal-republican-propaganda/" target="_blank">I noted recently</a> on <em>Care2</em>, the RNC&#8217;s decission to name <em></em>their test after Ronald Reagan seems curious considering he &#8212; nor any other modern president &#8212; could have passed.</p>
<p>From the <em>Care2</em> post:</p>
<blockquote><p>What struck me most about Bopp&#8217;s memo was not its requirements, but its invocation of Reagan.  Employing his name becomes more significant when paired with first item on the purity list:</p>
<p style="padding-left:30px;">(1) We support smaller government, smaller national debt, lower deficits and lower taxes by opposing bills like Obama’s “stimulus” bill;</p>

<p>Dawn Johnsen, Barack Obama&#8217;s nominee to head his administration&#8217;s Office of Legal Counsel (OLC), is potentially the most qualified candidate ever selected for the position.  <a href="http://indianapublicmedia.org/news/iu-professor-nominated-for-obama-administration/">Nominated</a> February 11 and approved by the Senate Judiciary Committee March 19, the Indiana University law professor has yet to be considered by the full Senate.  What&#8217;s the hold up, you may ask?  It appears that Johnsen is but another among many who has fallen victim to Republican obstructionism and the minority party&#8217;s <a href="http://www.youtube.com/watch?v=lN8G6NiaHeE">ongoing misuse of the filibuster</a>.</p>
<p>The Republican filibuster threat is only the most immediate cause for delay; forcing Senate Majority Leader, Harry Reid (D-NV) to scramble for the 60 votes necessary for cloture, followed by an up or down vote which would undoubtedly result in Johnsen&#8217;s confirmation.  The underlying causes behind GOP opposition to Johnsen stem from two ideological issues; one of which has been blown out of proportion by right-wing activists.  The other, more significant reason for fighting Obama&#8217;s OLC nominee is grounded in GOP fear that she, unlike her Bush administration OLC predecessors, may actually follow the law.</p>
<p>Right-wing activist opposition to Johnsen pertains to her past work for NARAL, a pro-choice advocacy organization.  More specifically, <a href="http://www.care2.com/causes/politics/blog/stop-gop-stalling-on-dawn-johnsen-olc-confirmation/"><img class="alignleft" title="Wouldn't it be nice..." src="http://dingo.care2.com/pictures/c2c/share/12/126/615/1261579_431.jpg" alt="" width="272" height="168" /></a>their objection pertains to a 1989 brief in which Johnsen&#8217;s organization &#8212; along with 76 others &#8212; argued against states having the right to prohibit abortions at public health institutions.</p>
<p>&nbsp;</p>
<p>Johnsen&#8217;s critics have zeroed in on two sentences within a footnote, which they employ claiming the OLC nominee equated motherhood with &#8220;involuntary servitude.&#8221;  It&#8217;s an assertion which <a href="http://www.politifact.com/truth-o-meter/statements/2009/mar/24/house-republicans/Republicans-accuse-White-House-nominee-Johnsen-of-/">Politifact declared</a>, March 24, to be &#8220;false.&#8221;</p>
<p>Of course, right-wing pundits further afield have taken Johnsen&#8217;s words and maliciously converted them, as <a href="http://conservativeamerican.org/tag/dawn-johnson-obama/">AmericanConservative.org did</a> September 19, placing the Obama nominee as number 41 among 650 unpalatable administration officials as, &#8220;Dawn &#8216;Compared Pregnancy with Slavery&#8217; Johnsen.&#8221;  No matter how it&#8217;s stated, however, Johnsen&#8217;s pro-choice stance is and has always been remarkably mainstream.</p>
<p>&#8220;The real reason&#8221; for the GOP stance in opposition to Dawn Johnsen was imparted by Scott Horton, March 26, at The Daily Beast:</p>
<blockquote><p>&#8230;Johnsen is committed to overturning the Bush administration’s policies on torture and warrantless surveillance, which would clip the wings of the imperial presidency. Even more menacingly (from their perspective), she is committed to shining a light on some of the darkest skeletons of the Bush years.</p></blockquote>
<p>If this is correct, then Horton&#8217;s assessment lends credence to that of Glenn Greenwald, whose aptly titled post, &#8220;<a href="http://www.salon.com/opinion/greenwald/2009/05/13/dawn_johnsen/">Dawn Johnsen&#8217;s belief in the rule of law disqualifies her from Senate consideration</a>,&#8221; was published May 13 at Salon.com. Within his post, Greenwald emphasized the fact that the Senate&#8217;s scrutiny of Johnsen was tragically absent in its confirmation of some previous, ultimately dubious, past nominees:</p>
<p>The Senate that is refusing to confirm Dawn Johnsen is the same Senate that confirmed Gen. Michael Hayden as CIA Director &#8212; with <a href="http://www.senate.gov/legislative/LIS/roll_call_lists/roll_call_vote_cfm.cfm?congress=109&amp;session=2&amp;vote=00160">overwhelming Democratic support</a> &#8212; even after it was revealed that he oversaw Bush&#8217;s illegal NSA spying program.  It&#8217;s the same Senate that confirmed Alberto Gonzales as Attorney General &#8212; with <a href="http://www.senate.gov/legislative/LIS/roll_call_lists/roll_call_vote_cfm.cfm?congress=109&amp;session=1&amp;vote=00003">substantial Democratic support</a> &#8212; even once everyone knew that he had played a key role in Bush&#8217;s torture program.  It&#8217;s the same Senate that &#8212; thanks to Democrats Dianne Feinstein and Chuck Schumer &#8212; confirmed Michael Mukasey as Attorney General even after he refused to say whether waterboarding was torture and <a href="http://tpmmuckraker.talkingpointsmemo.com/archives/004482.php">endorsed some of the most extremist presidential powers ever asserted in the U.S.</a></p>
<p>In other words, their covering their collective butts, and their doing so at the expense of a nation in desperate need of objective legal guidance.</p>
<p>Fortunately, there are those willing to tell their senators to quit stalling.  A good example of this was a September 22 letter from the Leadership Conference on Civil Rights, written behalf of several organizations, directing Senate Minority Leader Mitch McConnell (R-KY) to drop the stall tactics on Obama nominations.</p>
<p>The LCCR <a href="http://www.mainjustice.com/wp-content/uploads/2009/09/sept-22-lccr-mcconnell-stalled-nominations-sign-on-letter.pdf">letter</a> refers to Johnsen, specifically:</p>
<blockquote><p>&#8230;Professor Johnsen has already served with distinction in the OLC, and is undoubtedly well-qualified for the position. Her nomination was approved by the Senate Judiciary Committee in March.  The OLC plays a highly important role within the Administration, and the failure to confirm the President’s nominee to lead the office prevents the OLC from providing crucial legal advice on a wide range of issues currently confronting our nation.</p></blockquote>
